These Terms & Conditions ("Terms") govern your access to and use of the ParkU mobile application, web portal, and related services provided by ParkU Technologies Private Limited ("ParkU", "Company", "we", "our", or "us"). By accessing or using ParkU, you agree to be bound by these Terms.

1. About ParkU

ParkU is a cloud-based Software-as-a-Service (SaaS) platform designed to digitally manage entries, exits, and movement across physical locations. Depending on the subscribed features, the Platform enables organizations to:

  • Record vehicle entries and exits
  • Manage visitor entries
  • Record staff movements
  • Manage deliveries
  • Record contractor and vendor visits
  • Generate digital logs and reports
  • Monitor gate operations in real time
  • Manage multiple locations from a centralized dashboard

ParkU is a software platform only. ParkU does not:

  • Own or operate any physical premises
  • Provide security services
  • Employ security personnel
  • Verify the accuracy of manually entered information
  • Control operational decisions at customer locations

Customers remain solely responsible for managing and securing their premises.

2. User Roles

Administrator

The Administrator manages locations, subscriptions, users, permissions, and operational settings.

Security Guard

A Security Guard is authorized by the Administrator to record entries and exits using the ParkU mobile application. The Administrator is responsible for all activities performed under their organization and by users assigned to their account.

3. Subscription & Access

ParkU is offered exclusively as a subscription-based service. Access is provided on a per-location subscription basis, with each location operating as an independent workspace containing its own users, permissions, settings, and records.

Subscription plans are designed for different types of locations and operational requirements. Pricing, included features, supported users, and service limits may vary depending on the selected plan. Subscription plans may be based on factors including, but not limited to:

  • Type of location
  • Number of security guards
  • Number of managed locations
  • Included platform features
  • Storage capacity
  • Future service enhancements

ParkU may introduce new subscription plans, modify existing plans, revise pricing, add or discontinue features, or change usage limits from time to time. Existing customers will be notified in advance where required by applicable law. Certain premium modules, integrations, or future services may require separate subscriptions or commercial agreements.

Access to the Platform remains active only while the applicable subscription is valid and in good standing.

4. Payments

Subscription fees are billed in advance according to the selected billing cycle. Unless otherwise agreed in writing:

  • Subscription fees are non-refundable after activation.
  • Taxes and statutory charges, where applicable, are payable by the Customer.
  • Failure to complete payment may result in suspension or termination of Platform access.
  • ParkU may suspend paid services until outstanding payments are cleared.

ParkU is not responsible for financial, contractual, or operational disputes between customers and third parties.

5. Customer Responsibilities

Customers agree to:

  • Use the Platform only for lawful purposes.
  • Maintain accurate operational information.
  • Ensure only authorized personnel access the Platform.
  • Protect login credentials.
  • Supervise users assigned to their organization.
  • Ensure information entered into the Platform is accurate.
  • Comply with applicable laws and organizational policies.

Customers remain solely responsible for activities performed using their accounts.

6. Digital Records

ParkU maintains digital operational records created by authorized users. Depending on enabled modules, records may include:

  • Vehicle information
  • Visitor information
  • Staff movement
  • Delivery records
  • Contractor information
  • Entry and exit timestamps
  • User activity logs
  • Uploaded photographs
  • Supporting documents
  • Device information
  • Location information

Digital records are maintained for operational purposes and should not be considered official statutory records unless recognized under applicable law. ParkU records information exactly as entered by authorized users and does not independently verify its accuracy.

7. Acceptable Use

Users must not:

  • Create false or misleading records.
  • Manipulate or falsify operational data.
  • Share accounts without authorization.
  • Attempt unauthorized access.
  • Reverse engineer the Platform.
  • Upload malicious software.
  • Circumvent subscription limitations.
  • Use the Platform for illegal activities.

ParkU reserves the right to investigate suspected misuse and may suspend or terminate accounts without prior notice where necessary to protect the Platform, customers, or public interest.

8. Data Ownership & Intellectual Property

Customers retain ownership of operational data entered into the Platform. ParkU retains exclusive ownership of:

  • Software
  • Source code
  • Platform architecture
  • Design
  • Branding
  • Documentation
  • Features
  • Intellectual Property

Customers may not copy, reproduce, modify, distribute, reverse engineer, or create derivative works from the Platform without prior written permission.

9. Service Availability

ParkU is designed to provide reliable cloud-based services. However, temporary interruptions may occur due to:

  • Scheduled maintenance
  • Platform upgrades
  • Internet connectivity
  • Third-party cloud providers
  • Force majeure events
  • Circumstances beyond our reasonable control

While we strive for high service availability, uninterrupted access cannot be guaranteed.

10. Limitation of Liability

To the maximum extent permitted by law, ParkU shall not be liable for:

  • Security incidents at customer locations
  • Actions of security guards or administrators
  • Incorrect information entered by users
  • Loss of business, revenue, or profits
  • Operational decisions based on Platform data
  • Indirect, incidental, consequential, or punitive damages

The total liability of ParkU arising from any claim shall not exceed the subscription fees paid by the Customer during the twelve (12) months immediately preceding the event giving rise to the claim.

11. Suspension & Termination

ParkU may suspend or terminate access where:

  • Subscription payments remain unpaid.
  • These Terms are violated.
  • Fraudulent, abusive, or illegal activity is detected.
  • Continued access may compromise platform security or other customers.

Upon termination:

  • Platform access may be disabled.
  • Customer data may be retained in accordance with applicable laws and our data retention policy.
  • Outstanding payment obligations remain payable.

12. Governing Law

These Terms shall be governed by the laws of India. Any disputes arising from these Terms or use of the Platform shall be subject to the exclusive jurisdiction of the competent courts located in Andhra Pradesh, India.
